대법원은 21일 국외이송약취 사건에 대한 전원합의체 공개변론을 대법원 역사상 최초로 온라인을 통해 중계방송 한다.

이번 전원합의체에는 대법원장과 대법관 13명으로 구성되며 대법관 3분의 2이상이 출석하게 된다.

대법관들의 의견이 일치하지 않고 소수의 의견이 나오거나 그 사건이 종전에 대법원에서 판시한 규칙의 해석적용에 관한 의견을 변경할 필요가 있을 때 전원합의체(대법관회의)로 사건이 넘겨지게 되는데, 전원합의체의 판결은 앞으로 유사한 사건에 중요한 영향을 끼치는 판례로 남게 된다.

대법원은 “사회적 가치 판단이 필요한 중요 사안에 대해 국론이나 국민들의 의견이 분열돼 있을 때, 분열을 완화시키고 통합하는 방향을 제시해야 하는 대법원의 정책법원으로서의 기능과 역할을 확대하고 재조명하는 기회를 제공하기 위한 것”이라고 밝혔다.

사상 최초의 재판 중계가 예정된 사건은 국외이송약취 혐의로 기소된 베트남 여성 A씨(26) 사건이다.

A씨는 한국인과 결혼한 뒤 남편 동의 없이 생후 13개월이 된 자녀를 데리고 출국, 베트남 친정에 맡긴 혐의로 재판에 넘겨졌다.

1•2심은 “A씨가 남편과 협의 없이 자녀를 베트남으로 데리고 간 것은 다른 보호감독자인 남편의 감호권을 침해한 행위에 해당하지만 미성년자인 아이의 이익을 침해했다고는 단정할 수 없어 약취에 해당한다고 볼 수 없다”며 무죄로 판결했다.

검찰은 상고했고, 대법원은 이 사건을 접원합의체에 회부했다.

중계는 개인정보 유출을 막기 위해 실제 변론보다는 20분가량 지연방송한다.

대법원 관계자는 “이번 공개변론 사건은 이런 행위를 약취 죄로 처벌할 수 있는지에 관한 첫 선례가 될 것”이라고 설명했다.

이날 중계방송은 대한민국 법원 홈페이지(www.scourt.go.kr)와 포털사이트 네이버(www.naver.com)를 통해 이뤄진다.

Supreme Court trial to be broadcast online

A Supreme Court trial is to be streamed online for the first time in Korea in efforts to enhance public trust and transparency in the court proceedings.

The court sometimes comes under fire for its opaque and unfair judgment that represents the interests of certain parties, especially the “haves” and political big names.

Scheduled for next Thursday, the trial will be presided over by the chief justice, and at least two-thirds of the 13 Supreme Court justices will be seated.

This kind of trial is held when the cases are important enough to set a precedent for other cases down the road.

“The online broadcasting will be able to provide a venue where the public can discuss important issues that require value judgment,” said the Supreme Court through a statement, adding “it will also enable the court to expand its roles in setting directions for social unity.”

The trial involves a Vietnamese mother who moved back to the Vietnam with her 13-month old daughter allegedly without the consent of her Korean husband.

The prosecution booked her on charges of abduction, but both the first and second trials ruled that she was not guilty.

The courts said in the verdicts that “her acts can be seen as a breach on the husband’s care and custody rights of his child. However, it is hard to see that they infringe the interests of her daughter.”

The prosecutors later appealed to the Supreme Court.

The Supreme Court said the upcoming ruling will establish a precedent for other cases as it decides whether infringement by one parent on another parent’s care and custody rights is subject to criminal punishment.”

The trial starts from 2:10 p.m. but will be aired 20 minutes late to prevent encroachment on human rights and the privacy of the participants.

“People will be able to learn through the open trial about how law and order are established and justice is realized,” court officials said.
