Samsung wins dismissal of some apple smartphone patent claims in U.S. suit

Samsung Electronics Co. won dismissal of some of Apple Inc. (AAPL)’s claims over smartphone patents in a lawsuit in federal court in California.
The iPhone maker’s claims that Samsung misrepresented its intent to license certain patents on fair terms was dismissed and Samsung’s request to throw out some of Apple’s antitrust claims was granted in a ruling today by U.S. District Judge Lucy Koh in San Jose, California. Koh said Apple can amend its complaint to revive the claims.
Koh didn’t rule on Apple’s request to block Samsung from selling its Galaxy line of mobile devices in the U.S. based on claims they violate Apple patents.
Kristin Huguet, an Apple spokeswoman, didn’t immediately return an e-mail seeking comment on today’s ruling.
The legal fight between Apple and rival smartphone makers is intensifying as an increasing number of consumers use smart phones and wireless handsets to surf the Web, play games and download music and videos. Samsung and Apple have been involved in lawsuits since April, when Cupertino, California-based Apple filed the San Jose lawsuit claiming the Suwon, South Korea-based company’s Galaxy devices copied the iPhone and iPad.
The case is Apple Inc. v. Samsung Electronics Co., 11-1846, U.S. District Court, Northern District of California (San Jose).

삼성, 美서 애플특허권소송 일부 승소
애플이 미국에서 삼성전자를 상대로 낸 특허 침해 관련 판매금지 가처분 소송 중 일부가 법원에서 기각됐다.
미국 새너제이 소재 캘리포니아 북부지구 연방 법원은 18일(현지시간) 공정한 조건으로 특정 특허들의 사용을 허가하려는 애플의 의도를 삼성전자가 왜곡했다는 애플 측 주장을 기각했다.
또 삼성전자가 반독점 조항을 위배했다는 애플의 주장 일부를 기각해달라는 삼성전자 측 요청을 받아들였다.
담당 판사인 루시 고 판사는 그러나 삼성전자 갤럭시 스마트폰의 미국 내 판매를 금지해달라는 애플 요구에 대해서는 판결을 내리지 않았다.
고 판사는 또 애플이 소장을 변경, 다시 문제 제기를 하는 것은 가능하다고 밝혔다.
