Samsung brothers feud over inheritance

The founding family of Samsung Group, one of the Korea’s richest and secretive family, has become embroiled in a legal dispute over inheritance.

It was revealed Tuesday that Lee Maeng-hee, the eldest son of the late founder Lee Byung-chull, has filed a suit with a Seoul court, demanding Lee Kun-hee, the chairman and the third son, return what he says is his portion of the founder’s estate, worth nearly 700 billion won ($620 million).

He claims that his father had entrusted group shares under the names of several company executives but his brother, upon taking control of the group, ended the arrangement and moved them into his possession without the consent of other heirs.

He asked the court to order Lee Kun-hee to transfer 8.24 million shares of Samsung Life Insurance, 20 shares of Samsung Electronics and 100 million won.

He also claimed that Samsung Everland, the group’s de facto holding firm, holds some of the shares his father kept under the name of a third party and demanded it give him 100 shares in Samsung Life first.

As for the 20 Samsung Electronics shares he claimed, the 81-year-old Lee said he was making only a partial claim, because the exact size of his inheritance is unclear. According to local reports, he suspects that he has rights to some 570,000 shares in the firm.

Lee Kun-hee inherited the helm of the Samsung empire in 1987 upon the death of the group founder, whereas Lee Maeng-hee was made to run one of its units -- sugar refiner Cheil Jedang.

Cheil Jedang separated from the group in 1994 and has since grown into CJ Group which spans across food, logistics and entertainment businesses.

Lee Kun-hee claims that inheritance issues were settled during the spinoff process when he handed over his shares in the company to Maeng-hee’s first son Jae-hyun, who is now the chairman of CJ.

Samsung Group declined to comment on the suit, saying the lawsuit is the chairman‘s personal issue.

CJ Group said it would try to persuade Lee Myaeng-hee to drop the suit.

고(故) 이병철 삼성그룹 창업주의 장남인 이맹희(81) 전 제일비료 회장이 동생인 이건희(70) 삼성전자 회장을 상대로 거액의 소송 을 냈다.

이맹희씨는 이재현(52) CJ그룹 회장의 부친이다.

14일 서울중앙지법에 따르면 이맹희씨는 "아버지가 생전에 제3자 명의로 신탁한 재산을 이건희 회장이 다른 상속인에게 알리지 않고 단독 명의로 변경한 만큼 내 상 속분에 맞게 주식을 넘겨 달라"며 삼성생명 주식 824만주와 삼성전자 주식 20주 및 1억원을 지급하라는 주식인도 등 청구소송을 제기했다.

또 삼성에버랜드를 상대로도 삼성생명보험 주식 100주와 1억원을 청구했다.

전체 소송가액은 7천138억원으로 법무법인 화우에서 대리했으며, 법원장 출신을 포함해 변호사 10명이 투입됐다. 원고 이맹희씨는 현재 중국 베이징에 체류 중인 것 으로 전해졌다.

이맹희씨는 소장에서 "삼성생명과 삼성전자 주식은 아버지 생전에 제3자 명의로 신탁한 재산이고 아버지가 돌아가시면서 상속인들에게 법정상속분대로 상속됐어야 했다"며 "아버지가 타계한 이후 이건희 회장은 명의신탁 사실을 다른 상속인에게 알 리지 않고 2008년 12월 삼성생명 주식 3천248만주를 단독 명의로 변경한 만큼 내 상 속분인 189분의 48에 해당하는 824만주와 배당금을 돌려달라"고 요구했다.

이어 "삼성전자 차명주식은 일부 실명전환 사실만 확인되고 실체가 불분명해 우 선 일부 청구로 보통주 10주, 우선주 10주만 인도할 것을 요구한다"고 덧붙였다.

원고 측이 주장하는 삼성전자 주식 상속분은 잠정치로 약 57만주에 달하는 것으 로 알려졌다. 이에 따라 확장 청구가 된다면 이번 소송 가액은 천문학적 규모가 될 것으로 보인다.

이맹희 씨는 또 "1998년 12월 차명주주로부터 삼성에버랜드가 매입하는 형식으 로 명의를 변경한 삼성생명주식 3천447만주도 법정상속분에 따라 반환돼야 한다"며 "현재로서는 이 부분 주식 명의변경 경위가 불분명해 삼성에버랜드를 상대로는 일부 인 100주만 청구한다"고 덧붙였다.

이맹희씨는 지난해 6월 이건희 회장 측으로부터 받은 `상속재산 분할 관련 소명 ' 문서에 차명재산이 언급돼 있는 것을 보고 차명재산의 존재를 알게됐다고 설명했 다.

또 "이건희 회장 측에서는 차명재산에 대해 상속인들이 협의해서 이 회장 소유 로 하기로 했으며 그렇지 않더라도 소송을 낼 수 있는 제척기간(10년)이 지났다고 주장한다"며 "하지만, 그같은 협의는 있지 않았고 삼성생명 주식 명의 변경은 2008 년 12월에 있었으므로 제척기간도 지나지 않았다"고 반박했다. (연합뉴스)
