The British High Court prohibited a man with an IQ of 48 from having sex, the British newspaper Daily Telegraph reported.
The judge ordered that the man, known as Alan, should not be allowed to have sex because he “does not have the capacity to consent and engage in sexual relations.”
The report said that Alan had been in a sexual relationship with a man he lived with in a house provided by the town council. The town council took court action over Alan’s contact with the man on the grounds that he lacked the mental capacity to engage in sexual relations.
The judge also ordered the local authority to watch closely over him to see whether he breaks the order or not.
According to the report, under the Mental Capacity Act 2005, British judges can make decisions for people considered to lack the intelligence to make them themselves, such as ordering surgery, abortions, having life-support switched off or using contraception.
According to the court ruling, Alan was described as “sociable” and “presented as an able man” but was “seriously challenged in all aspects of his mental functionality.”
Meanwhile, the court ordered the man be given sex education “in the hope that he thereby gains that capacity.”

IQ가 낮은 남자는 성생활도 하지 못한다?
영국 고등법원이 IQ가 48인 한 남자에게 성관계를 가질 수 없도록 판결을 내려 눈길을 끌고 있다.
판사는 이 남자가 성적인 관계를 승낙하거나 관여할만한 능력이 되지 않는 다고 판단하여 성관계를 가질 수 없다고 판결을 내리고, 지역 사회에 이 남자가 명령을 지키도록 감시할 것을 명령했다.
알렌으로 불리는 이 남자는 지역 의회가 제공한 집에서 살고 있었으며, 같이 살고 있던 남자와 성적인 관계를 가지게 되었다.
그리고 지역 의회는 알렌과 그 남자와의 접촉에 대해 법원에 소송을 제기하였고 법원은 알렌이 성적인 관계를 가질만한 정신적인 능력이 되지 않는 다고 판단하여 금지했다.
영국의 정신능력법 (Mental Capacity Act, 2005)에는 지적 능력 낮은 사람을 대신하여 수술, 낙태, 피임, 호흡기 판사가 의사결정을 내릴 수 있다고 한다.
한편 법원은 알렌이 성 교육을 받도록 명령했다.
