대선개입 게시글 73건…문재인?안철수?이정희 거론 비판 `축소ㆍ은폐' 김용판 前서울청장 선거법 위반…총 5명 기소

검찰이 '국가정보원의 대선•정치 개입 의혹' 사건과 관련, 불법 정치개입 댓글의 책임을 물어 원세훈 전 국정원장을 불구속 기소했다.
이 사건을 수사 중인 서울중앙지검 특별수사팀(팀장 윤석열)은 14일 원 전 원장 에게 공직선거법 제85조(지위를 이용한 선거운동 금지) 1항 위반 및 국정원법 제9조 (정치관여 금지) 혐의를 적용해 불구속 기소했다.
원 전 원장은 '종북세력'의 범위를 임의로 지나치게 넓게 잡아 강력 대응을 지시했고 이에 직원들은 젊은층이 많이 찾는 인터넷 사이트에서 국정원의 직무 범위를 넘는 '정치•대선 개입' 게시글과 댓글 작성 등 불법 행위를 한 사실이 드러났다.
검찰에 따르면 원 전 원장은 취임 이후 지난해 대선 전까지 국정원 직원들이 인터넷 사이트 수십 곳에서 수백 개의 아 이디를 동원해 1천900여건의 정치•대선 관여 게시글을 올리고 1천700여차례 댓글에 대한 찬반 표시를 올리도록 지시하며 사후 보고를 받은 혐의를 받고 있다.
이 가운데 검찰이 선거 개입으로 판단한 게시글은 73개이며 선거 관련 글에 달린 찬반 투표는 1천280여개이다.
게시글 중 문재인 당시 민주당 후보 당사자를 직접 거론하거나 민주당의 정책을 비판한 글은 37건으로 드러났다.
이정희 당시 통합진보당 후보와 통진당을 비판한 글은 32건, 대선 유력 주자였 던 안철수 예비 후보를 비판한 게시글은 4건이었다.
검찰은 원 전 원장의 지시에 따라 심리전단 직원들이 조직적으로 인터넷에서 정 치•대선 관여 활동을 한 것으로 파악했다.
검찰은 원 전 원장이 선거운동을 할 수 없음에도 지위를 이용, 본인이 생각하는 종북좌파의 제도권 진입을 막기 위해 낙선 목적의 선거 운동을 하게 한 것으로 판단 했다.
검찰은 국정원 본부로 추적된 아이피(IP)로도 특정 대선후보들을 지지•비방하는 내용의 게시글 60여개를 올린 사실을 확인해 작성자를 추적 중이다.
국정원 직원이 사용한 걸로 보이는 트위터 계정에서도 특정 후보들에 대한 지지 •비방 글이 320여개 발견돼 확인 중이다. 검찰은 트위터 서버가 해외에 있어 해당 국가에 사법공조를 요청한 상태다.
검찰은 국정원의 이종명 전 3차장, 민모 전 심리전단장, 김모 심리전단 직원 등 3명, 외부 조력자 이모씨 등 6명에 대해서는 전 원 기소유예 했다. 원 전 원장의 지시에 따른 범행으로서 상명하복 관계의 조직 특성 등을 감안한 것으로 보이나 `봐주기' 수사 아니냐는 지적이 나온다.
고발되지 않은 심리전단 직원들은 입건 유예됐다. 검찰 수사 과정에서 별도로 고발된 박모 전 국정원 국장은 계속 수사키로 했다.
검찰은 원 전 원장이 북한의 대남심리전에 대응하는 과정에서 북한의 동조를 받 는 사람과 단체까지 종북세력으로 보는 그릇된 인식 때문에 직무범위를 넘어서는 불 법적인 지시를 하게 됐다고 판단했다.
검찰은 원 전 원장의 불법적 지시에 따라 국정원 심리전단이 북한•종북세력 대 처 명목으로 특정 정당 및 정치인에 대해 지지•반대 의견을 유포하거나 선거운동 활동을 한 사실을 확인했다고 밝혔다.
검찰은 지난해 경찰의 수사 과정에서 축소•은폐를 지시한 김용판 전 서울지방경찰청장을 공직선거법 위반과 경찰공무원법 위반, 형법상 직권남용 혐의로 기소했다.
함께 고발된 김기용 전 경찰청장에게는 범행 가담 사실을 인정할 증거가 없어 무혐의 처분을 내렸다.
검찰은 국정원 여직원 고발 사건을 수사한 서울 수서경찰서가 대선 3일 전인 지 난해 12월16일 "대선후보 관련 비방•지지 게시글이 발견되지 않았다"는 취지의 중간 수사 결과를 발표하는 과정에서 김 전 청장이 부당하게 개입한 사실을 확인했다.
당시 서울청은 수서서로부터 여직원 컴퓨터에 대해 증거분석을 의뢰받아 김씨 의 ID와 게시글 등을 확인했으나 이를 수서서에 제공하지 않았다. 수서서의 증거분석 결과물 회신 요청도 거부해 결과적으로 수사팀의 정상적인 수사 진행을 방해했다 .
검찰은 정상적인 수사 공보를 빙자한 수사결과 발표가 대선 직전 이례적으로 이뤄진데다 그 내용이 특정 후보자에게 유•불리하도록 왜곡됐다고 판단, 수사 결과 발표를 주도한 김 전 청장에게 관련 혐의를 적용했다.
검찰은 국정원 의혹 폭로 과정에서 발생한 비밀 누설과 관련, 직원 정모씨와 전직 직원 김모씨를 각각 불구속 기소했다. 정씨는 국정원직원법 위반 및 선거법 위반 혐의가, 김씨는 선거법 위반 혐의가 각각 적용됐다.
검찰은 정씨가 국정원 직원들의 신상 정보 등을 전 직원 김씨에게 누설해 민주당의 선거기획에 활용되도록 했다고 판단했다. 정씨는 심리전단 관련 정보를 누설한 사실이 발각돼 내부 감찰을 받자 '원장님 지시•강조 말씀자료' 일부를 메모해 유출, 민주당 측에 전달했다.
검찰은 국정원 여직원의 오피스텔 앞에서 감금 행위를 한 혐의로 고발된 민주당 당직자 정모씨 등 관련자들이 출석 요구에 불응, 계속 수사해 사법처리 여부를 결정 할 방침이다.
지난달 서울경찰청 압수수색 과정에서 업무용 컴퓨터의 삭제파일 복구를 불가능 하게 만든 사이버범죄수사대의 박모 증거분석팀장은 증거인멸 혐의로 불구속 기소했다.

Prosecutors on Friday indicted former National Intelligence Chief Won Sei-hoon without physical detention on charges of meddling in last year’s presidential election.
Announcing the results of its two-month-long probe, the Seoul Central District Prosecutors’ Office said Won ordered his agents to put up online comments and express opinions on Internet posts over political issues.
Among 1,760 posts by the NIS agents with hundreds of fake IDs from Sep. 19 to Dec. 14 last year, 67 are confirmed to have violated the election law.
Of 67, three comments criticized then-presidential candidate Moon Jae-in of the Democratic Party; 26 vilified Rep. Lee Jung-hee and the United Progressive Party; and three attacked Rep. Ahn Cheol-soo, an independent.
“Former NIS chief Won, in his duty to counter psychological warfare schemes by North Korea, recognized even people or organizations whose policies or opinions are supported by pro-North Korean groups or North Korea as those supporting the North,” said the prosecutors’ office in its statement.
Former Seoul Metropolitan Police Agency chief Kim Yong-pan was also indicted on charges of violating election and police laws and abuse of authority. He was not detained.
According to the prosecutors’ office, Kim tried to pressure a police team at Suseo Police Station in southern Seoul investigating NIS agents last year to hurriedly announce an interim result days before the election, clearing the agents of charges of smear campaigning.
The district police said at the time that no evidence of political interference of the agents was found.
The SMPA also tried to hide computer hard disks handed over by the police team in an attempt to conceal the case.
An NIS agent and a former agent who were involved in a revelation of inside information of the intelligence service were indicted without detention.
The prosecutors charged the current spy agent surnamed Jung for violating the laws on the agency and the election law, and the former agent surnamed Kim for violating the election law.
Jung handed over documents detailing directions of Won and personal information of NIS officials to Kim. The prosecution judged the inside information was utilized in election campaigns of an opposition party.
Meanwhile, the prosecutors suspended the indictment of five NIS officials and a civilian who participated in and supported the online operations, considering that they were simply following Won’s directions.
Mobilized to run the online smear campaigns under a warfare psychological team of the NIS, the agents put up a number of comments online advocating government-led projects while vilifying opposition political figures in an attempt to sway public opinion in favor of the ruling Saenuri Party as well as of then-presidential candidate and current President Park Geun-hye.
Since they were directed by Won, the prosecutors decided not to indict them, according to the prosecutors’ office.
The prosecutors said that they would continue a separate probe into some DP officials who are accused of trapping an NIS agent within her residence on Dec. 11 while attempting to question her on the covert operations from outside.
