김영주 새누리당 의원이 대법원에서 당선 무효형이 확정됐다.
대법원 1부(주심 양창수 대법관)는 12일 공직선거법 위반 혐의로 불구속 기소된 김 의원에 대한 상고심에서 징역 10월의 실형을 선고한 원심을 확정했다. 이에 따라 김 의원은 이날 자로 의원직을 상실했다.
김 의원은 지난해 총선을 앞두고 “50억원을 제공하면 당선권에 있는 비례대표 후보로 공천해주겠다”는 심상억 전 선진당 정책 연구원장의 말을 듣고 이를 약속한 혐의로 기소됐다. 선진당 비례대표로 국회의원이 된 김 의원은 지난해 11월 선진당이 새누리당과 합당하면서 당적이 바뀌었다. 1심과 2심에서는 김 의원의 혐의를 유죄로 보고 징역 10월을 선고했다.
국회의원은 공직선거법 또는 정치자금법 위반 혐의로 기소돼 벌금 100만원 이상의 형이 확정되면 당선무효가 된다. 법원 판결은 선고와 동시에 효력이 발생하기 때문에 검찰은 곧바로 형집행 절차에 들어갈 수 있다. 김 의원은 늦어도 수일 내 구치소에 수감될 것으로 보인다.

Saenuri lawmaker loses seat for buying nomination
The ruling Saenuri Party’s Rep. Kim Young-joo lost his parliamentary seat after the Supreme Court on Thursday upheld a 10-month prison term for violating the Public Official Election Act.
Under related regulations, receiving prison terms or being fined more than 1 million won ($950) for violating the Public Official Election Act or the Political Fund Act results in an automatic annulment of election results.
Kim, a first term proportional representative, was indicted in September for allegedly promising to lend 5 billion won to the Advancement and Unification Party in return for a being nominated as a proportional representative in last year’s general elections. The Advancement and Unification Party was absorbed by the ruling party ahead of last year’s presidential election.
Along with Kim’s sentence, the court also upheld the one-year prison term given to Shim Sang-uck, who had headed the Advancement and Unification Party’s research organ, for making the deal with Kim.
