A set of photos and data files depicting a young Korean woman engaged in sexual acts has been spreading fast on Korean file-sharing websites, causing controversy over human rights violation and punishment of the disseminators.

The data files were first uploaded to a local online community on Monday, and quickly went viral through social networking services and file-sharing platforms such as torrents.

The rapid circulation of the revealing personal files is drawing worries about human rights violations among netizens, as some Internet users tracked down and spread her personal information such as name, residence, school and even social networking profile information.

Some argued that the suspect who spread the data files should be penalized even when the victim first posted the data on the Internet. It is not yet clear whether the victim was the one who uploaded the file in the first place.

According to the Personal Data Protection Act legislated in 2011, any person who makes public others’ personal information without their consent can be sentenced to up to five years in prison or a fine up to 50 million won ($45,880).

한 20대 여성의 적나라한 모습을 담은 영상과 음성 정보가 포함된 데이터파일이 국내 웹사이트들을 통해 확산되면서 인권침해와 유포자 처벌에 관한 논란이 일고 있다.

이 데이터파일은 지난 월요일 한 국내 온라인 커뮤니티에 처음 게시된 후 기타 커뮤니티 사이트와 소셜네트워크서비스, 그리고 P2P 파일 공유 프로그램 ‘토렌트’를 통해 빠른 속도로 확산됐다.

이 파일의 급격한 확산은 일부 네티즌들이 악의적으로 피해자 여성의 실명, 거주지, 출신대학교, SNS 주소 등 개인정보를 추적해 퍼뜨리기 시작하면서 인권 침해에 대한 우려를 낳고 있다.

일부에서는 이 같은 ‘신상털기’는 애초에 이 파일을 업로드 한 사람이 피해자 자신이었다 하더라도 이를 퍼뜨린 사람들을 법적으로 처벌해야 한다고 주장했다. 2011년 제정된 ‘개인정보보호법’에 따르면 ‘정보주체’의 동의를 받지 않고 개인정보를 제3자에게 제공한 자와 제공받은 자는 최대 5년 이하의 징역 혹은 5000만원 이하의 벌금에 처할 수 있다. (코리아헤럴드)
