The Seoul Central District Court dismissed Wednesday the appeals of eight online community members convicted of libel for spreading false rumors that hip-hop artist Tablo falsified his academic background at Stanford University.

Online cafe “We Demand Tablo Tell the Truth,” known as “Tajinyo” in Korean, began operating in May 2010, accusing the Epik High member of lying about his academic achievement to court popularity.

As malicious comments snowballed online, Tablo filed a lawsuit against 22 members of the online café for libel in August 2010. In October 2010, the cyber crime team at Seocho Police Station announced it had checked Tablo’s certificate and transcript from Stanford and confirmed that he earned a bachelor of arts and master’s degree at the prestigious U.S. university.

The court upheld the initial trial ruling against nine internet users for libel and confirmed their prison terms.

In July, four of the nine “Tajinyo” members, none of whom have a previous criminal record, were sentenced to eight months in prison, suspended for three years. Another two, also without any previous convictions, received ten-month jail terms, suspended for 2 years.

The judge ruled that three netizens who insulted Tablo even after being accused of defamation should serve their 10 months jail terms.

“We cannot accept the defendants’ claim that the sentence from the first trial was an injustice. The motivation of the crime was impure, the method was thoughtless and the same practice was repeated several times,” the court said in the ruling.

Tablo allegedly demanded the judges give the online café members stern punishment.

“The scar (from the scandal) was too great to forgive Tajinyo,” he said, according to a local media report.

In the statement, the judge also pointed out that social problems were another reason for severe punishment.

“Not only ‘Tajinyo,’ but also malicious online comments and bullying thrive in this society. It’s reasonable to punish people considering the serious situation of today to set an example.”

타블로, 긴 법정 공방 끝! ‘타진요' 실형

가수 타블로의 학력의혹을 제기하고 허위사실을 유포한 인터넷카페 ‘타진요(타블로에게 진실을 요구합니다)’의 회원들이 항소심 결심 공판에서 모두 유죄 판결을 받았다. 법원은 ‘타진요’에 대해 “범행 의도가 불순하고 방법이 천박하며 피해결과가 심각하다”는 판단을 내렸다.

서울중앙지법 형사항소 2부(부장판사 박관근)은 10일 정보통신망 이용촉진 및 정보보호 등에 관한 법률위반(허위사실 유포에 의한 명예훼손) 혐의로 기소된 타진요 회원 이모씨를 비롯한 2명에 대해 원심과 같은 징역 10월을 선고하고, 다른 5명 역시 징역 8월~10월에 집행유예 2년을 선고했다.

이날 결심 공판에서 박관근 부장판사는 “타진요 회원의 양형부당 항소를 받아들이지 않는다”면서 “타진요의 의도가 불순하고 방법이 천박하며 피해결과가 심각하다. 무엇보다 피해자의 엄벌의지가 유지되고 있다”고 설명했다.

박 판사는 이어 “우리 사회에서 악플이 활개치고 왕따가 생기는 현실에서 일벌백계가 필요하다”고 강조하며 이같은 판결을 내렸다.

지난 2010년 초 ‘왓비컴즈’라는 아이디를 쓰는 한 네티즌은 타블로의 학력위조 의혹을 제기하며 파문을 불러왔다. 결국 경찰이 직접 나서 타블로의 미국 스탠포드 대학 졸업사실을 밝히며 사건은 일단락됐다. 이후 같은해 8월 타블로는 ‘타진요’ 회원들을 명예훼손 혐의로 고소한 바 있다.

지난 7월 결심공판에서 타진요 회원 9명 중 4명은 잘못을 뉘우치고 있으며 전과가 없는 점을 감안해 징역 8월에 집행유예 2년, 전과는 없으나 그 비방 수위가 직접적인 2명에 대해선 징역 10월에 유예 2년, 고소를 당한 후에도 지속적으로 타블로를 모욕한 4명은 징역 10개월을 선고했다. 

재판부는 "비단 '타진요'뿐 아니라 현재 수많은 악플이 난무하고 왕따 문제가 심각한 상황에서 이들을 일벌백계하는 것이 마땅하다. 사회의 경종을 울릴 필요가 있다"며 중형 선고의 이유를 설명했다.
