Samsung Electronics has landed in hot water after leaking iPhone-related documents to the media on Tuesday, disobeying an order by a U.S. judge in charge of the legal battle with Apple.

Judge Lucy Koh had barred Samsung from making public the phone design documents as evidence because its submission was “too late” under the U.S. legal process.

The evidence revealed by Samsung amid the ongoing legal fight with Apple includes a testimony by Shin Nishibori, Apple’s former designer, saying that his early iPhone designs were inspired by Sony products.


Samsung also disclosed the proof that it had already been developing a smartphone called “F700” in 2006 before Apple’s iPhone was released.

According to the analysis by the Verge, a news media outlet specializing in the IT industry, Samsung revealed the evidence in consideration of an appeal after Apple wins the current lawsuit.

The media said that the evidence gives Samsung a strong legal footing to prove that the company did not copy Apple’s design, as well as its argument that Apple’s iPhone design is not original in the first place.

삼성, '법원금지문건' 깜짝 공개


삼성전자가 지난달 31일 미 법원 판사가 공개를 금지한 증거 문건을 언론에 배포하면서 큰 파장이 일고 있다.

미국 새너제이 법원의 루시 고 판사는 삼성전자 측의 해당 증거 제출 시일이 미국 법정 절차의 규정보다 늦어진 것을 이유로 해당 증거 문건의 공개를 금지한 바 있다.

이번에 삼성이 언론에 공개한 증거 문건은 애플의 전 디자이너인 니시보리 신이 자신의 초기 아이폰 디자인이 소니 사의 제품을 다수 차용했다는 증언이 포함되어 있으며, 이 외에도 애플이 아이폰을 내놓기 이전인 2006년 이미 삼성전자가 스마트폰인 “F700” 모델을 개발중이었다는 증거 문건도 담겨있다.

IT 전문 매체인 더 버지(The Verge)는 삼성이 법원의 명령에 불복하면서까지 굳이 금지 문건을 공개한 이유가 애플이 소송에서 승리한 이후 항소하는 상황을 염두에 두었기 때문이라고 분석했다.

더 버지는 이 증거 문건을 통해 삼성이 애플의 디자인을 도용하지 않았음은 물론, 애플의 아이폰 디자인이 애초에 독창적인 것이 아니었음을 증명하는 강력한 법적 증거가 될 수 있다고 밝혔다.
