Samsung wins U.K. Galaxy Tab design suit

Samsung Electronics Co. on Monday won a design patent suit in the United Kingdom against Apple Inc., scoring a legal victory in the midst of a spate of ongoing patent lawsuits with its global rival, industry sources said.

The British High Court of Justice ruled in favor of the South Korean tech giant, saying the Galaxy Tab, its tablet PC, does not infringe Apple’s registered design and that consumers are not likely to be confused, according to the sources.

The ruling came after Samsung filed a suit at the London court against Apple in September 2011, requesting an affirmation that its Galaxy Tab series did not copy the iPad design.

Samsung welcomed the ruling, saying that “it affirmed that our products do not infringe Apple’s registered design right.”

“The industry could be harmed should Apple continue to make excessive legal claims in other countries based on such generic designs,” the Korean tech behemoth said in an emailed statement.

Market watchers noted the U.K. court judgment runs in contrast to a series of similar design patent suits between Samsung and Apple, filed in the United States in June last year.

On June 26, 2011, the District Court of Northern California accepted Apple’s claims that Samsung violated its patents.

It was followed by an appeal case ruling last week, which turned down the Korean firm’s request to allow the sales of its tablet computers until the patent suit with Apple is wrapped up.
