Samsung Electronics Co. won an intellectual property ruling against Apple Inc. as a U.K. judge said the Galaxy tablet isn’t “cool” enough to be confused with the design for the iPad.

The Galaxy tablet doesn’t infringe Apple’s registered design, Judge Colin Birss said in a ruling today in London. He said that consumers weren’t likely to get the two tablet computers mixed up.

The Galaxy tablets “do not have the same understated and extreme simplicity which is possessed by the Apple design,” Birss said. “They are not as cool.”

Apple is fighting patent lawsuits around the globe against rivals including HTC Corp. and South Korea-based Samsung as it competes for dominance of the smartphone and tablet computer markets. The firms have accused each other of copying designs and technology used in mobile devices.

An e-mail to Apple’s U.K. media relations team wasn’t immediately answered. Tom Leeder, an external spokesman for Samsung, declined to immediately comment when reached by telephone. (Bloomberg)

"애플만큼 멋지지 않다" 삼성 굴욕 준 판사 

영국 법원은 9일(한국시간) 애플이  삼성전자 의 갤럭시 탭 태블릿PC에 대해 제기한 특허 침해소송에서 삼성전자의 손을 들어줬다 고 블룸버그통신이 보도했다. 

영국 법원은 삼성전자 갤럭시탭이 애플의 특허를 침해하지 않았으며 소비자들이 두 제품을 혼동할 만큼 디자인이 유사한 것으로 볼 수 없다고 결정했다. 

콜린 브리스 판사는 갤럭시탭이 애플이 특허권을 주장하는 아이패드 디자인의 단순성을 모방했다고 보이지 않는다고 밝혔다.

영국 법원의 이번 결정은 지난달 갤럭시탭 10.1 모델의 판매 중지 가처분 신청을 받아들인 미국 캘리포니아 지방법원의 결정과 상반되는 결과여서 향후 미국 등에 서 진행될 본안 소송에서 삼성전자의 승소 전망을 밝게 해준 것으로 풀이됐다.

애플은 삼성전자와 HTC 등 안드로이드 진영 후발 업체들을 상대로 각국에서 특허 침해 소송을 벌이고 있으며, 삼성전자도 이에 대응해 맞소송에 나서고 있다.

삼성전자는 지난달 26일 미국 캘리포니아 북부 새너제이 지방법원이 갤럭시탭 1 0.1에 대한 판매금지 가처분 신청을 받아들이자 집행정지요청(motion to stay)을 내 고 항고 절차를 밟고 있다.

이에 앞서 네덜란드 법원은 애플이 삼성전자의 3세대 이동통신 특허권을 침해했다며 삼성에 대해 피해를 보상하라는 판결을 내린 바 있다.
