Sex offenders barred from medical, home schooling services

SEOUL, Jan. 2 (Yonhap) -- Convicted sex offenders will be banned from working as health-care providers or home-study teachers from the second half of this year, the government said on Monday.

The Ministry of Gender Equality and Family said convicted sex offenders will be barred from holding such jobs as medical doctors, dentists and nurses as well as home-study teachers in addition to the existing list under a bill that passed the National Assembly on Friday.

The job prohibition will last for 10 years from the day the offenders finished or were exempted from serving penalties.

Currently, offenders are banned from running or working at educational organizations or other children-related facilities such as daycare centers and hagwons, or private learning institutes.

The bill would also scrap the statute of limitations for rape against the disabled and children under age 13 in a move to implement stronger punishments for those who prey on the most vulnerable, according to the ministry.

성범죄자, 의료인-학습지 교사 못한다

올 하반기부터 성범죄자는 10년간 의료인 또는 학습지 교사로 일할 수 없고 업무상 위계·위력에 의한 추행죄는 피해자의 처벌의사가 없더라도 처벌받는다.

여성가족부는 '아동·청소년의 성보호에 관한 법률' 개정안이 지난해 12월30일 국회를 통과해 성범죄자 취업제한 직종에 의료인과 학습지 교사가 추가되는 등 성범 죄자에 대한 처벌이 강화된다고 2일 밝혔다.

여성부는 의사, 간호사 등 의료인은 신체를 다루는 직종이고 학습지 교사는 가정을 방문해 아동·청소년과 직접 접촉하는 직종이어서 성범죄자 취업제한에 포함됐 다고 설명했다.

또 그동안 성범죄 피해자의 처벌의사가 있을 때 가해자를 처벌했으나 가해자가 처벌을 면하려고 무리한 합의를 종용하는 등 폐해가 잇따라 피해자의 처벌의사와 무 관하게 처벌키로 했다.

성범죄 피해자 등에 대한 정보 보호도 대폭 강화된다.

성범죄 피해를 당하였거나 성매수 대상이 된 아동·청소년의 정보(주소, 성명, 연령, 학교 또는 직업, 용모, 사진 등)를 누설한 사람이나 이를 신문 등 인쇄물에 싣거나 방송을 통해 공개한 사람에 대한 처벌이 7년 이하의 징역 또는 5천만원 이하 의 벌금으로 강화된다.

또 관련 정보를 종업원이 공개한 경우 사업주와 법인도 함께 처벌받는다.

13세 미만의 여아나 장애 여성에 대한 강간죄(준강간죄 포함)에 대한 공소시효도 폐지된다.

이번 개정안은 국회에서 통과돼 공포 후 6개월이 경과하는 올 하반기부터 시행될 예정이다.
