서울고법 형사9부(김주현 부장판사)는 무죄를 선고한 원심을 깨고 의지할 데 없는 하나뿐인 딸을 성추행한 혐의로 A씨(40)에게 징역 7년을 선고하고 법정구속했다고 17일 밝혔다.

또 A씨에게 성폭력 치료 프로그램 80시간 이수를 명하고 개인정보를 10년 동안 공개하기로 했다.

작년 10월 당시 법원은 “사랑받지 못하고 자라서 어른한테 관심을 끌고 싶어하는 피해자가 다른 사람에게 잘 보이고 싶어 연극을 했다”며 무죄를 선고했다.

재판부는 공소사실을 뒷받침하는 유일한 직접 증거인 피해자의 진술이 자꾸 바뀌어서 온전히 믿을 수 없다고 판단했다.

하지만 이번 판결에서 재판부는 “A씨는 비슷한 방법으로 1년 넘게 수차례 범행했다”며 “피해자가 범행 시점을 정확히 모른다고 해서 신빙성을 부인할 수 없다”고 판시했다. 특히 “피해자의 진술 태도로 미뤄 도저히 연극을 하고 있다고 보기 어렵다”고 지적했다.

재판부가 유죄로 인정한 공소사실에 따르면 A씨는 피해자가 잠든 사이 옷 안으로 손을 넣어 몸을 더듬거나 강제로 성행위를 했다. 부모가 이혼한 후 모친 쪽에 맡겨진 피해자는 상습 폭행을 당하다 버려졌고, 친척 집을 전전하던 중 간혹 찾아오는 A씨에게 성폭력을 당했다. A씨는 끝까지 성추행 혐의를 인정하지 않았다.

Man jailed for 7 years for sexual assault of daughter

The Seoul High Court sentenced a South Korean father to seven years in prison for habitual sexual assault of his daughter. 

The court’s decision overturns that of last year’s original trial, when he was found not guilty.

According to the court, the daughter’s testimony was not consistent at the time, and it was thought that she was trying to win attention from adults by making false statements. 

The court said the suspect, 40, assaulted the daughter for a year by groping her in her sleep or forcing her to have sex. It said the credibility of her story should not be denied just because the daughter cannot remember the exact dates of the violations.

The father denied any wrongdoing.
