Three foreign law firms have been allowed to offer foreign legal consultancy services in South Korea for the first time, the Justice Ministry said Sunday.

   The three firms permitted to open branches in Seoul to provide international law-related consultancy services are Ropes & Gray, Sheppard Mullin and Clifford Chance, the ministry said, noting they registered themselves as foreign legal consultants about a month ago.

   It is the first time that the Seoul government has permitted the establishment of foreign legal consultants.

   The three law firms can launch international law consultancy services in South Korea after registering with the Korean Bar Association.

   The London-based Clifford Chance is the world's third-largest global law firm, while the U.S.-based Ropes & Gray is ranked around 30th worldwide.

   Following the enforcement of South Korea's free trade agreement with the European Union and the U.S. over the past year, foreign law firms have attempted to rush into the South Korean market. So far, a total of eight have been registered as foreign legal consultants.

   Under an FTA-related legal service market liberalization plan agreed upon with the EU and the U.S., foreign law firms will be allowed by March 2014 to ally with Korean law firms to engage in domestic legal service operations. In the third and final stage, the nation's legal service market will be fully liberalized by March 2017. (Yonhap News)

외국로펌, 한국 법률시장 공식 진입!


법무부는 '롭스 앤 그레이(Ropes & Gray)', '쉐 퍼드 멀린(Sheppard Mullin)', '클리포드 챈스(Clifford Chance)' 등 외국 로펌 3곳 에 대해 외국법 자문 법률사무소 설립을 인가한다고 15일 밝혔다.

    설립인가를 받은 외국 로펌들은 약 한 달 전 외국법 자문사 등록을 마쳤으며, 앞으로 대한변호사협회에 등록하면 합법적으로 국내 사무소를 개설하고 외국법 자문 에 관한 법률사무를 취급할 수 있다.

    외국법 자문사에 대한 설립 인가는 이들 로펌 3곳이 처음이다.

    클리포드 챈스는 영국계 최대 법무법인으로 세계 3대 로펌 중 하나로 꼽히고 있 으며, 롭스 앤 그레이도 세계 30위권에 드는 대형 로펌으로 알려져 있다.

    외국 로펌들은 지난해 7월 한·EU(유럽연합) 자유무역협정(FTA)과 지난 3월  한 미 FTA 발효를 계기로 앞다퉈 국내 진출을 시도했으며 현재 총 8곳이 외국법 자문사 등록을 마쳤다.

    또 미국 로펌 7곳과 영국 로펌 2곳이 외국법 자문사 자격심사를 받고 있어 앞으 로 외국 대형 로펌의 국내 법률시장 진출이 잇따를 전망이다.

    현재 국내 법률시장 개방은 1단계로 외국법 자문사들이 국내 사무소를 개설해 외국법 자문 업무만 처리할 수 있는 수준이다.

    그러나 내년 7월 2차 법률시장 개방(한·EU FTA 기준, 한미 FTA는 2014년  3월) 이 시작되면 외국 로펌이 국내 법인과 제휴해 국내법 사무를 일부 처리할 수 있게 되며, 2016년 7월(한미 FTA는 2017년 3월)부터는 국내변호사를 고용해 국내 소송 등 도 맡을 수 있는 3단계로 사실상 완전 개방이 이뤄진다.
