A U.S. judge said Facebook’s “like” buttons are not protected as free speech and employees fired for “liking” something written on Facebook cannot protected by the legal shield, according to news reports.
The ruling came after six employees of Hampton Virginia Sheriff B.J. Roberts were fired for supporting Roberts’ opponent Jim Adams during his 2009 re-election campaign. At that time, three of the six had “liked” the Facebook page of Adams.
The six employees filed a lawsuit in the Eastern District of Virginia, claiming their First Amendment rights were violated.
However, U.S. District Judge Raymond Jackson has ruled against the employees, saying the First Amendment covers only actual statements on social media, not “liking” a Facebook page.

페이스북 ‘좋아요’ 누르고 해고당해도 할말 없어
미국에서 페이스북의 ‘좋아요’ 버튼을 누르는 것은 표현의 자유를 명시한 수정헌법 제1조의 보호를 받지 못한다는 판결이 나와 논란이 일고 있다.
이 판결은 버지니아주 햄프턴의 보안관실에 근무하던 6명의 직원이 2009년에 당시 상관이었던 보안관 B.J. 로버츠가 상대 후보였던 짐 애덤스와 재선을 놓고 선거운동을 벌이는 와중에 애덤스의 페이스북 페이지에 들어가 ‘좋아요’ 표시를 한 것으로 해고된 후 로버츠를 상대로 ‘표현의 자유가 침해되었다’고 소송을 제기하면서 나온 것이다.
레이몬드 잭슨 버지니아 지방법원 판사는 로버츠의 손을 들어주며, 수정헌법 제1조는 페이스북에 실제로 게시한 글까지는 보호할 수 있지만 ‘좋아요’ 표현까지 헌법의 보호를 받을 수는 없다고 전했다.
