Student sues to wear anti-homophobia shirt

An Ohio teen has filed a lawsuit saying his high school principal violated his First Amendment rights by preventing him from wearing an anti-homophobia T-shirt.

Maverick Couch, 16, said in the federal lawsuit filed Tuesday Waynesville High School Principal Randy Gebhardt prevented him from wearing a T-shirt that said "Jesus Is Not A Homophobe," the Dayton Daily News reported Wednesday.

Gebhardt told Couch to turn the shirt inside out April 15, 2011, and to remove it completely a week later, the lawsuit said. Couch said Gebhardt threatened to suspend him if he wore the garment a third time.

In January Lambda Legal, a non-profit law firm advocating lesbian, gay, bisexual and transgender rights, sent a letter to Gebhardt urging the school district to "take appropriate steps so that no further action will be necessary to ensure that students in your school freely exercise their First Amendment right of expression."

William Deters, the school district's lawyer, responded Feb. 24 saying Gebhardt "was well within the bounds of his authority" and the "T-shirt was sexual in nature and therefore indecent and inappropriate in a school setting."

The lawsuit seeks an award of "nominal damages" to cover court costs in addition to a court order allowing Couch to wear the shirt, declaring the school district violated his rights, the newspaper said. (UPI)

미국 오하이오 주의 한 십대가 소속 고등학교 교장이 동성애혐오증에 대해 반대의사를 나타내는 티셔츠 착용을 금지시키자 미국 수정헌법 제 1조에 위배된다며 법원에 소송을 제기했다.

매베릭 코취(16)는 지난 화요일 위니스빌 고등학교(Waynesville High School)의 교장 랜디 겝할드가 “예수는 동성애혐오자가 아니다.”라고 쓰인 티셔츠를 입지 못하게 했다고 지역 신문을 통해 전했다.

교장은 지난 2011년 4월 15일 이 학생에게 상의를 뒤집어 입으라고 말하고 그 다음주에는 그 셔츠를 아예 입지 말라고 말했다. 코치는 교장이 그 옷을 다시 입을 경우 정학조치를 취하겠다고 협박했다고 말했다.

동∙양성애자와 성전환자들의 인권을 지지하는 비영리 단체인 람다 법률 사무소는 지난 1월 교장에게 “이 사건에 대한 소송이 필요치 않도록 해당 학생이 표현의 자유를 보장하는 적의 조치를 취하라.”는 서한을 보냈다.

이에 학교측 변호사는 지난 2월 24일 “교장이 가진 권한의 선 안에서 행동했고 (학생이 입은) 티셔츠는 성적인 메시지를 담아 교내 착용이 부적절했다.”고 말했다.

이 소송은 학교가 학생의 인권을 침해했다고 주장하며 코치가 옷을 입을 수 있도록 허용할 것과 소송비용을 지불하라는 ‘명목적 손해 배상’을 청구했다.
