Constitutional Court to rule on new antigraft act

[THE INVESTOR] The constitutionality of the new antigraft law is to be decided on July 28, the Constitutional Court of Korea said on July 25.

The so called “Kim Young-ran Act” is set to go into effect in September, and will impose penalties for receiving gifts or entertainment on a wide range of professions. As the act currently stands, staff of news organizations and private schools are subjected to the act. 


The inclusion of journalists and private school staff has been met with criticism and resistance from concerned organizations, which filed constitutional appeals immediately after the act passed the National Assembly last year.

The Constitutional Court has been reviewing the appeals as a single case, and has been focusing on four main points.

The appeals claimed that the act infringed upon the freedom of press, and the rights of private educational institutions. The clauses that requires the spouses of those working in concerned fields to report gifts and entertainment received is another major point of contention.
