법원, 미성년자 성폭행범에 첫 '화학적 거세' 명령

법원이 미성년자 성폭행범에 대한 성충동 약물치료(화학적 거세) 청구를 처음으로 받아들였다.

서울남부지법 형사11부(김기영 부장판사)는 3일 미성년자 5명을 성폭행한 혐의(성폭력범죄의 처벌 등에 관한 특례법 위반)로 구속기소된 표모(31)씨에 대해 징역 15년을 선고하고 성충동 약물치료 3년, 전자발찌 부착 20년, 정보공개 10년, 성폭력 치료 프로그램 200시간 이수를 명령했다.

재판부는 "피고인은 강간치상, 특수강도강간 등으로 징역형을 산 적이 있으며 누범 기간에 이번 범행을 저질렀다"며 "다수 피해자를 상대로 장기간에 걸쳐 범행했으며 왜곡된 성의식을 갖고 있고 성욕과잉인 것으로 보여 스스로 통제가 불가능한 상태로 판단된다"고 밝혔다.

이어 "약물치료가 피고인의 과다한 성적 환상과 충동을 감소시키는데 도움이 될 것"이라며 "중증으로 보여 치료 3년을 명한다"고 덧붙였다.

재판부는 "피고인이 범행을 자백했지만 청소년 피해자의 성을 사고 나아가 강간했으며 그 장면을 촬영해 협박까지 하는 등 죄질이 극히 불량하다"며 "피해자들은 극도의 성적 수치심을 느꼈을 것이고 강력한 처벌을 바라고 있다"고 양형 이유를 설 명했다.

바리스타인 표씨는 지난 2011년 11월부터 7개월간 스마트폰 채팅으로 만난 10대 중반의 여성 청소년 5명과 6차례에 걸쳐 성관계를 가진 뒤 이들의 알몸 사진, 성관계 동영상을 인터넷 등에 퍼뜨리겠다면서 흉기로 협박해 성폭행한 혐의로 기소됐다.

정부는 지난 2011년 7월 성폭력 범죄자의 성충동 약물치료 제도를 시행했으며, 검찰은 지난해 8월 표씨에 대해 처음으로 법원에 성충동 약물치료 명령을 청구했다.

현재까지 검찰이 청구한 성충동 약물치료 명령은 전국적으로 이번 건을 포함해 4건이다.

지난해 5월 아동 성폭행범인 박모(46)씨에 대해 성충동 약물치료 명령이 내려졌지만 이는 법무부 치료감호심의위원회 결정으로, 그 기간도 최대 3년이라는 점에서 검찰이 최대 15년까지 청구할 수 있는 이번 사례와는 다르다.

당초 표씨에 대한 선고공판은 지난달 27일로 예정돼 있었지만 당일 오전 표씨가 탈진 증세를 보여 법원에 출석하지 못하면서 선고가 1주일 연기됐다. (연합뉴스)

Court orders chemical castration of pedophile

A Seoul court on Thursday ordered the forcible “chemical castration” of a repeated rapist of teenage girls in the first such ruling since the measure was introduced in 2011.

The Seoul Southern District Court ruled that the 31-year-old man surnamed Pyo should be put under hormonal treatment for three years designed to curb his libido.

The measure was on top of 15 years’ imprisonment, 20 years of electronic monitoring through an ankle bracelet, 200 hours of mandatory rehabilitation and online disclosure of personal information for 10 years that Pyo received upon conviction for charges including the rape of five girls under 16.

“The accused is deemed unable to control his sexual drive, given that he assaulted several victims over a long period of time,” presiding judge Kim Ki-young said.

It was the first time for a court here to sentence a sex offender to chemical castration since the National Assembly passed in July 2011 the bill allowing the administration of anti-sex hormone medications for convicted child molesters over 19.

Pyo, however, is not the first person to undergo the treatment.

A 46-year-old pedophile surnamed Park is currently receiving the treatment, following a decision in May last year from the Medical Treatment and Custody Deliberation Committee under the Justice Ministry.

Under the law, chemical castration can be imposed either by a court sentence or committee decision. The court can order the administration of the drugs for up to 15 years, while the latter can order it only for 3 years.
