Nexon, which has been suspected of leaking personal information of its 13 million customers, was not indicted because of a lack of evidence, according to the announcement by Seoul Central Prosecutor’s Office on Friday.

The prosecutor’s office said that the three accused including Seo Min, the CEO of Nexon Korea, are cleared of the charge that the company lost the personal information of 13 million users of its massively multiplayer online role-playing game “Maple Story” as a result of hacking attacks in November.

An official at the prosecutor’s office said that “it is difficult to say that the company has not taken proper measures to protect the personal information of users.“

“We cannot punish the company as the related law has no specific stipulation about proper precautions that companies should take.” he added.

1300만 개인정보유출 넥슨 '무혐의'



서울중앙지검은 온라인게임 메이플스토리 이용자 1천320만명의 개인정보 유출 사건과 관련, 넥슨에 대해 최근 증거불충분으로 불기소 처분했다고 3일 밝혔다.

지난해 11월 메이플스토리의 백업 서버가 해킹돼 1천320만명의 개인정보가 유출된 사건이 발생했다.

검찰은 개인정보 유출을 막기 위한 관리 조치를 소홀히 한 혐의로 경찰에서 기소 송치된 넥슨코리아 서민(41) 대표 등 3명을 무혐의 처분했다.

검찰 관계자는 “넥슨이 개인정보 보호 조치를 제대로 취했느냐가 쟁점인데 당시 나름의 조치를 했고 개인정보 관리를 게을리했다고 보기도 어렵다”고 설명했다.

이 관계자는 또 “최고수준의 보안장치를 가동하더라도 해커의 침입을 원천적으로 막을 수 있다는 보장이 없고, 어느 정도 수준의 예방 조치가 적절한지 법령에 구체적으로 명시돼 있 지 않아 처벌이 어렵다”고 덧붙였다.
