Plastic surgeon ordered to compensate patient after releasing photos

A local court has ordered a plastic surgeon to pay compensation to a patient for posting her before-and-after photos on their website without her consent.

The Seoul Central District Court ruled Sunday that the surgeon should pay 30 million won ($26,000) to the patient who claims to have suffered psychological damage from the circulation of her image which was later used on other internet sites. She had surgery on her nose at his clinic.

“The doctor violated the patient’s portrait rights by posting the before-and-after photos without her consent and is obliged to pay compensation for her psychological damage,” said the judge Jeong Do-young.

The female college student in her 20s who aspires to be an actress had the operation in 2009. Her photos were taken during the surgical procedure.

She found later that her photos had been posted on the clinic’s website for commercial use and sued the surgeon, seeking 40 million won.

The surgeon claimed that eyes were blurred in the photos to hide her identity but the court rejected the argument, saying the patient was recognizable due to other distinct features.

법원, 성형 '전ㆍ후사진' 무단게재 배상판결

성형수술 '전(before)과 후(after)'를 비교한 사진을 무단게재한 성형외과 의사에게 법원의 배상판결이 내려졌다.

서울중앙지법 민사23단독 정도영 판사는 성형수술 전후 사진을 무단으로 공개해 피해를 봤다며 A(여)씨가 서울 소재 모 성형외과 원장 B씨를 상대로 낸 손해배상 청구소송에서 "B씨는 A씨에게 3천만원을 지급하라"며 원고 일부 승소로 판결했다고 16 일 밝혔다.

정 판사는 "A씨의 코 성형수술 전ㆍ후 사진은 사회 통념상 누군지 알아볼 수 있는 신체적 특징을 담아 초상권 보호대상이고, B씨는 A씨의 허락을 받지 않고 진료과정에서 확보한 사진을 영업에 이용하려 인터넷에 게재해 초상권을 침해했으므로 정신적 피해를 배상할 의무가 있다"고 밝혔다.

이어 "연기자 지망생으로 수술 당시 20세 남짓한 피해자가 심각한 충격을 받았고 사진이 각종 인터넷 포털사이트에 게재돼 피해가 지속된 점, 사진 원본 파일을 삭제하라는 A씨의 요구를 B씨가 거부한 점을 고려하면 위자료 액수는 3천만원이 적절하다"고 덧붙였다.

정 판사는 눈 부위를 모자이크 처리해 식별을 어렵게 한 만큼 초상권을 침해하지 않았다는 B씨의 주장에 대해서는 "조작에도 불구하고 A씨임을 알아보기에 충분하다"며 받아들이지 않았다.

대학생이던 A씨는 2009년 B씨가 운영하는 성형외과에서 코 성형수술을 받았으며 , 당시 B씨는 수술 전후의 상태를 비교해야 한다며 얼굴 사진을 찍었다.

이후 B씨는 자신이 운영하는 성형외과 로고와 함께 사진을 포털사이트에 광고용으로 게재했고, 이를 발견한 A씨는 정신적 고통에 시달리다 손해배상금으로 4천만원을 지급하라며 법원에 소송을 냈다. (연합뉴스)
